2. จากการใช้งานเว็บไซต์หรือบริการของบริษัท เช่น ข้อมูลอุปกรณ์ คุกกี้ และข้อมูลการใช้งาน
3. จากผู้ให้บริการของบริษัท เช่น ผู้ให้บริการด้านเทคโนโลยี การชำระเงิน การจัดส่ง หรือระบบที่เกี่ยวข้องกับการบริหารข้อมูลลูกค้า
4. จากแพลตฟอร์มหรือช่องทางที่ท่านใช้ติดต่อกับบริษัท ภายใต้ข้อกำหนดและนโยบายของแพลตฟอร์มนั้น
5. จากบุคคลหรือพันธมิตรอื่น ในกรณีที่สามารถดำเนินการได้ตามกฎหมาย

ในกรณีที่บริษัทได้รับข้อมูลส่วนบุคคลจากแหล่งอื่น บริษัทจะดำเนินการแจ้งข้อมูลตามที่กฎหมายกำหนด เว้นแต่เข้าข้อยกเว้นตามกฎหมาย

การวิเคราะห์หรือการปรับแต่งที่เกี่ยวข้องกับข้อมูลส่วนบุคคลจะดำเนินการตามฐานทางกฎหมายและการตั้งค่าความเป็นส่วนตัวที่เกี่ยวข้อง

ในกรณีที่กฎหมายกำหนดให้ต้องได้รับความยินยอม บริษัทจะขอความยินยอมจากท่านก่อนดำเนินการดังกล่าว

ท่านสามารถถอนความยินยอมหรือยกเลิกการรับการสื่อสารทางการตลาดได้ตามช่องทางที่บริษัทจัดไว้ให้

การถอนความยินยอมจะไม่กระทบต่อความชอบด้วยกฎหมายของการประมวลผลที่เกิดขึ้นก่อนการถอนความยินยอม และไม่กระทบต่อการติดต่อที่จำเป็นต่อการให้บริการ เช่น การยืนยันคำสั่งซื้อ การชำระเงิน หรือการจัดส่งสินค้า

• ปฏิบัติตามคำสั่งหรือคำขอที่ชอบด้วยกฎหมายจากหน่วยงานรัฐ
• ดำเนินการเกี่ยวกับข้อพิพาทหรือข้อเรียกร้อง
• ปกป้องสิทธิ ทรัพย์สิน และประโยชน์โดยชอบด้วยกฎหมายของบริษัท ลูกค้า หรือบุคคลอื่น

 

 

6. ฐานทางกฎหมายในการประมวลผลข้อมูลส่วนบุคคล

บริษัทจะพิจารณาฐานทางกฎหมายที่เหมาะสมกับวัตถุประสงค์และกิจกรรมในการประมวลผลข้อมูลแต่ละประเภท โดยฐานทางกฎหมายที่อาจนำมาใช้ ได้แก่:

6.1 การปฏิบัติตามสัญญา

เช่น

• การรับและดำเนินการตามคำสั่งซื้อ
• การจัดส่งสินค้า
• การดำเนินการชำระเงิน
• การให้บริการลูกค้า
• การดำเนินการตามคำขอของท่านก่อนหรือระหว่างการเข้าทำสัญญา
  

6.2 การปฏิบัติตามกฎหมาย

เช่น การเก็บรักษาข้อมูลหรือเอกสารเพื่อปฏิบัติตามหน้าที่ทางกฎหมาย บัญชี ภาษี หรือข้อกำหนดของหน่วยงานที่มีอำนาจตามกฎหมาย

6.3 ประโยชน์โดยชอบด้วยกฎหมาย

ในกรณีที่สามารถใช้ฐานนี้ได้ตามกฎหมาย เช่น

• การรักษาความปลอดภัย
• การป้องกันการทุจริต
• การบริหารความสัมพันธ์กับลูกค้า
• การปรับปรุงสินค้าและบริการ
• การปกป้องสิทธิและทรัพย์สินของบริษัท

ในการใช้ฐานประโยชน์โดยชอบด้วยกฎหมาย บริษัทจะพิจารณาความจำเป็นของการประมวลผลและผลกระทบต่อสิทธิและเสรีภาพของเจ้าของข้อมูลประกอบกัน

6.4 ความยินยอม

7. กรณีที่ท่านไม่ให้ข้อมูลส่วนบุคคล

ข้อมูลส่วนบุคคลบางประเภทอาจมีความจำเป็นต่อการทำสัญญา การรับคำสั่งซื้อ การชำระเงิน การจัดส่งสินค้า การให้บริการ หรือการปฏิบัติตามกฎหมาย

หากท่านไม่ให้ข้อมูลที่จำเป็น บริษัทอาจไม่สามารถดำเนินการตามคำสั่งซื้อ ให้บริการ จัดส่งสินค้า ดำเนินการชำระเงิน หรือดำเนินการอื่นที่เกี่ยวข้องได้

สำหรับข้อมูลที่ไม่จำเป็นต่อการให้บริการ ท่านสามารถเลือกที่จะไม่ให้ข้อมูลดังกล่าวได้ โดยการไม่ให้ข้อมูลดังกล่าวอาจทำให้บริษัทไม่สามารถให้บริการหรือปรับแต่งประสบการณ์บางส่วนแก่ท่านได้

8.2 ผู้ให้บริการที่บริษัทใช้งานในปัจจุบัน

Shopify

บริษัทใช้ Shopify เป็นแพลตฟอร์มอีคอมเมิร์ซและระบบเว็บไซต์ ซึ่งอาจเกี่ยวข้องกับการประมวลผลข้อมูล เช่น ข้อมูลลูกค้า ข้อมูลคำสั่งซื้อ ข้อมูลบัญชี และข้อมูลทางเทคนิคที่จำเป็นต่อการให้บริการ

Opn / Omise

บริษัทใช้บริการชำระเงินออนไลน์ของ Opn / Omise สำหรับธุรกรรมที่ลูกค้าเลือกชำระผ่านช่องทางดังกล่าว

ข้อมูลการชำระเงินที่จำเป็นอาจถูกส่งหรือประมวลผลโดยผู้ให้บริการดังกล่าวตามเงื่อนไขและนโยบายของผู้ให้บริการ

ผู้ให้บริการจัดส่งสินค้า

บริษัทอาจส่งข้อมูลที่จำเป็น เช่น

• ชื่อ
• ที่อยู่
• หมายเลขโทรศัพท์
• รายละเอียดที่จำเป็นต่อการจัดส่ง

ให้แก่ผู้ให้บริการจัดส่งสินค้าเพื่อดำเนินการจัดส่งคำสั่งซื้อ

ผู้ให้บริการอื่น

หากบริษัทใช้ผู้ให้บริการรายอื่นที่มีการประมวลผลข้อมูลส่วนบุคคล บริษัทจะดำเนินการให้สอดคล้องกับกฎหมายและเปิดเผยข้อมูลเท่าที่จำเป็นต่อวัตถุประสงค์ที่เกี่ยวข้อง

บริษัทจะไม่ถือว่ารายชื่อผู้ให้บริการในส่วนนี้เป็นรายชื่อที่ครอบคลุมผู้ให้บริการทุกรายตลอดเวลา เนื่องจากบริษัทอาจเปลี่ยนแปลง เพิ่ม หรือลดผู้ให้บริการตามความเหมาะสมในการดำเนินธุรกิจ

8.3 พันธมิตรทางธุรกิจ

บริษัทอาจเปิดเผยข้อมูลแก่พันธมิตรทางธุรกิจเท่าที่จำเป็นและเมื่อมีฐานทางกฎหมายรองรับ

8.4 หน่วยงานรัฐหรือบุคคลที่มีอำนาจตามกฎหมาย

บริษัทอาจเปิดเผยข้อมูลเมื่อจำเป็นเพื่อปฏิบัติตามกฎหมาย คำสั่งศาล หรือคำสั่งของหน่วยงานรัฐที่มีอำนาจตามกฎหมาย

8.5 ธุรกรรมทางธุรกิจ

ผู้ให้บริการภายนอกจะได้รับข้อมูลเท่าที่จำเป็นต่อการให้บริการ และจะประมวลผลข้อมูลตามขอบเขต วัตถุประสงค์ และเงื่อนไขที่เกี่ยวข้อง

บริษัทจะพิจารณาจัดทำข้อตกลงหรือมาตรการที่เหมาะสมกับผู้ให้บริการดังกล่าวตามที่กฎหมายกำหนดหรือเหมาะสมกับลักษณะการประมวลผล

 

 

10. คุกกี้และเทคโนโลยีที่คล้ายคลึงกัน

บริษัทอาจใช้คุกกี้และเทคโนโลยีที่คล้ายคลึงกันเพื่อ:

• จดจำการตั้งค่าของท่าน
• วิเคราะห์การใช้งานเว็บไซต์
• วัดประสิทธิภาพของเว็บไซต์

• สนับสนุนการตลาดและโฆษณา
• ปรับปรุงประสบการณ์การใช้งาน

เว็บไซต์หรือบริการของบริษัทอาจใช้ Shopify และบริการจากผู้ให้บริการเทคโนโลยีหรือบุคคลที่สามอื่น

ผู้ให้บริการดังกล่าวอาจเก็บรวบรวม ใช้ หรือประมวลผลข้อมูลส่วนบุคคลตามบทบาทของผู้ให้บริการและเงื่อนไขของบริการนั้น

บริษัทจะดำเนินการตามกฎหมายที่เกี่ยวข้องและใช้มาตรการที่เหมาะสมในการควบคุมหรือจัดการการประมวลผลข้อมูลส่วนบุคคลของผู้ให้บริการภายนอกตามบทบาทของแต่ละฝ่าย

ผู้ใช้งานควรศึกษานโยบายความเป็นส่วนตัวและข้อกำหนดของผู้ให้บริการภายนอกที่เกี่ยวข้องเพิ่มเติม

12. เว็บไซต์และบริการของบุคคลที่สาม

เว็บไซต์ของบริษัทอาจมีลิงก์ เครื่องมือ หรือบริการที่เชื่อมต่อกับเว็บไซต์หรือแพลตฟอร์มของบุคคลที่สาม

เมื่อท่านใช้งานเว็บไซต์หรือบริการของบุคคลที่สาม ข้อมูลของท่านอาจอยู่ภายใต้นโยบายความเป็นส่วนตัวของบุคคลที่สามนั้น

บริษัทไม่รับผิดชอบต่อแนวทางการคุ้มครองข้อมูลส่วนบุคคลของเว็บไซต์หรือบริการของบุคคลที่สามที่อยู่นอกเหนือการควบคุมของบริษัท

บริษัทแนะนำให้ท่านตรวจสอบนโยบายความเป็นส่วนตัวของบุคคลที่สามก่อนให้ข้อมูลส่วนบุคคลแก่บุคคลดังกล่าว

13. ข้อมูลของเด็กและผู้เยาว์

บริการของบริษัทไม่ได้มีวัตถุประสงค์โดยเฉพาะสำหรับเด็ก

บริษัทจะดำเนินการเกี่ยวกับข้อมูลของเด็ก ผู้เยาว์ หรือบุคคลที่อยู่ภายใต้ข้อจำกัดด้านความสามารถในการให้ความยินยอมตามที่กฎหมายกำหนด

หากการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลจำเป็นต้องได้รับความยินยอมจากบิดามารดา ผู้ปกครอง หรือผู้มีอำนาจตามกฎหมาย บริษัทจะดำเนินการให้เป็นไปตามข้อกำหนดของกฎหมายที่เกี่ยวข้อง

14. การรักษาความมั่นคงปลอดภัยของข้อมูลส่วนบุคคล

บริษัทจัดให้มีมาตรการรักษาความมั่นคงปลอดภัยของข้อมูลส่วนบุคคลที่เหมาะสมตามความเสี่ยง ลักษณะของข้อมูล และลักษณะการประมวลผล เพื่อป้องกันการสูญหาย การเข้าถึง การใช้ การเปลี่ยนแปลง แก้ไข หรือเปิดเผยข้อมูลโดยไม่ได้รับอนุญาตหรือโดยมิชอบ

มาตรการดังกล่าวอาจรวมถึง:

• การควบคุมสิทธิการเข้าถึงข้อมูล
• การกำหนดสิทธิการเข้าถึงตามหน้าที่
• การรักษาความปลอดภัยของระบบสารสนเทศ
• การจัดการบัญชีผู้ใช้งาน
• การรักษาความปลอดภัยของอุปกรณ์และระบบ
• การสำรองข้อมูลตามความเหมาะสม
• การอบรมหรือกำหนดหน้าที่ของบุคลากร
• การตรวจสอบและจัดการเหตุการณ์ด้านความปลอดภัย
• มาตรการอื่นที่เหมาะสมกับความเสี่ยง

อย่างไรก็ตาม ไม่มีระบบรักษาความปลอดภัยใดที่สามารถรับประกันความปลอดภัยของข้อมูลได้อย่างสมบูรณ์

15. การแจ้งเหตุละเมิดข้อมูลส่วนบุคคล

หากเกิดเหตุละเมิดข้อมูลส่วนบุคคล บริษัทจะดำเนินการตรวจสอบ ประเมินความเสี่ยง และดำเนินการตามหน้าที่และระยะเวลาที่กฎหมายกำหนด

ในกรณีที่กฎหมายกำหนดให้บริษัทต้องแจ้งเหตุละเมิดต่อสำนักงานคณะกรรมการคุ้มครองข้อมูลส่วนบุคคล หรือแจ้งเจ้าของข้อมูลส่วนบุคคล บริษัทจะดำเนินการตามหลักเกณฑ์และระยะเวลาที่กฎหมายกำหนด

16. ระยะเวลาในการเก็บรักษาข้อมูลส่วนบุคคล

บริษัทจะเก็บรักษาข้อมูลส่วนบุคคลเท่าที่จำเป็นต่อวัตถุประสงค์ในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูล หรือตามระยะเวลาที่กฎหมายกำหนดหรืออนุญาต

ระยะเวลาในการเก็บรักษาอาจแตกต่างกันตามประเภทของข้อมูล ดังนี้:

16.1 ข้อมูลคำสั่งซื้อและธุรกรรม

บริษัทจะเก็บรักษาข้อมูลคำสั่งซื้อ ธุรกรรม และเอกสารที่เกี่ยวข้องตามระยะเวลาที่จำเป็นต่อการดำเนินธุรกิจ การบัญชี ภาษี การตรวจสอบ การปฏิบัติตามกฎหมาย และการปกป้องสิทธิของบริษัท

ข้อมูลหรือเอกสารบางประเภทอาจจำเป็นต้องเก็บรักษาเป็นระยะเวลานานตามลักษณะของข้อมูลและข้อกำหนดทางกฎหมายที่เกี่ยวข้อง

16.2 ข้อมูลบัญชีลูกค้า

บริษัทจะเก็บรักษาข้อมูลตราบเท่าที่บัญชีของท่านยังใช้งานอยู่ หรือเท่าที่จำเป็นต่อการให้บริการ

16.6 ข้อมูลจากแบบประเมินที่มีข้อมูลส่วนบุคคลที่มีความอ่อนไหว

บริษัทจะเก็บรักษาข้อมูลส่วนบุคคลที่มีความอ่อนไหวเฉพาะเท่าที่จำเป็นต่อวัตถุประสงค์ที่แจ้งไว้และตามฐานทางกฎหมายที่เกี่ยวข้อง

เมื่อหมดความจำเป็น บริษัทจะลบ ทำลาย หรือทำให้ข้อมูลไม่สามารถระบุตัวบุคคลได้ เว้นแต่กฎหมายกำหนดหรืออนุญาตให้เก็บรักษาต่อไป

16.7 ข้อมูล Cookie และบันทึกความยินยอมเกี่ยวกับ Cookie

บริษัทจะเก็บข้อมูลที่เกี่ยวข้องกับการตั้งค่าหรือความยินยอมเกี่ยวกับ Cookie เท่าที่จำเป็นต่อการบริหารจัดการความเป็นส่วนตัว การพิสูจน์การตั้งค่าของผู้ใช้งาน และการปฏิบัติตามกฎหมาย

โดยทั่วไป บริษัทอาจเก็บบันทึกดังกล่าวไม่เกิน 2 ปี เว้นแต่มีความจำเป็นหรือข้อกำหนดทางกฎหมายอื่นที่เกี่ยวข้อง

เมื่อข้อมูลส่วนบุคคลไม่มีความจำเป็นต้องเก็บรักษาอีกต่อไป บริษัทจะดำเนินการลบ ทำลาย หรือทำให้ข้อมูลไม่สามารถระบุตัวบุคคลได้ตามความเหมาะสมและตามกฎหมาย

17. การโอนข้อมูลส่วนบุคคลไปต่างประเทศ

ในการดำเนินธุรกิจ บริษัทอาจใช้บริการจากผู้ให้บริการเทคโนโลยีและผู้ให้บริการภายนอกซึ่งอาจมีการประมวลผลหรือจัดเก็บข้อมูลส่วนบุคคลในต่างประเทศ

ตัวอย่างเช่น ข้อมูลที่ประมวลผลผ่านแพลตฟอร์ม Shopify อาจถูกโอนหรือประมวลผลในประเทศที่ Shopify บริษัทในเครือ หรือผู้ให้บริการที่เกี่ยวข้องตั้งอยู่ ทั้งนี้ ประเทศและสถานที่ในการประมวลผลอาจเปลี่ยนแปลงได้ตามโครงสร้างและการให้บริการของผู้ให้บริการในแต่ละช่วงเวลา

ในกรณีที่มีการส่งหรือโอนข้อมูลส่วนบุคคลไปยังต่างประเทศ บริษัทจะดำเนินการให้สอดคล้องกับหลักเกณฑ์เกี่ยวกับการโอนข้อมูลส่วนบุคคลไปยังต่างประเทศตามกฎหมายไทย

บริษัทจะพิจารณาใช้มาตรการ กลไก หรือข้อกำหนดที่เหมาะสมตามที่กฎหมายกำหนดหรืออนุญาต เช่น ข้อตกลงที่เกี่ยวข้องกับการประมวลผลข้อมูล หรือกลไกคุ้มครองข้อมูลอื่นที่เหมาะสมกับกรณี

บริษัทจะไม่โอนข้อมูลส่วนบุคคลไปต่างประเทศเกินกว่าความจำเป็นสำหรับวัตถุประสงค์ในการให้บริการหรือวัตถุประสงค์ที่ระบุไว้ในนโยบายนี้

18. สิทธิของเจ้าของข้อมูลส่วนบุคคล

ภายใต้เงื่อนไขและข้อยกเว้นตามกฎหมาย ท่านอาจมีสิทธิเกี่ยวกับข้อมูลส่วนบุคคลของท่าน ได้แก่:

1. สิทธิในการเข้าถึงข้อมูลส่วนบุคคล
2. สิทธิในการขอรับสำเนาข้อมูลส่วนบุคคล
3. สิทธิในการขอให้แก้ไขข้อมูลส่วนบุคคลให้ถูกต้องและเป็นปัจจุบัน
4. สิทธิในการขอให้ลบหรือทำลายข้อมูลส่วนบุคคล
5. สิทธิในการขอให้ระงับการใช้ข้อมูลส่วนบุคคลในบางกรณี
6. สิทธิในการคัดค้านการประมวลผลข้อมูลส่วนบุคคลในกรณีที่กฎหมายกำหนด
7. สิทธิในการถอนความยินยอม
8. สิทธิในการขอรับหรือโอนย้ายข้อมูลส่วนบุคคลในกรณีที่กฎหมายกำหนด
9. สิทธิอื่นใดตามที่กฎหมายคุ้มครองข้อมูลส่วนบุคคลกำหนด

สิทธิดังกล่าวอาจมีข้อจำกัดหรือข้อยกเว้นตามกฎหมาย และบริษัทจะพิจารณาคำขอแต่ละกรณีตามข้อเท็จจริงและกฎหมายที่ใช้บังคับ

การถอนความยินยอมจะไม่กระทบต่อความชอบด้วยกฎหมายของการประมวลผลข้อมูลที่ได้ดำเนินการไปแล้วก่อนการถอนความยินยอม

19. วิธีการใช้สิทธิ

บริษัทอาจขอข้อมูลเพิ่มเติมที่จำเป็นเพื่อยืนยันตัวตนของผู้ร้องขอ และเพื่อป้องกันการเปิดเผยข้อมูลส่วนบุคคลแก่บุคคลที่ไม่มีสิทธิ

บริษัทจะพิจารณาและดำเนินการตามคำขอภายในระยะเวลาและเงื่อนไขที่กฎหมายกำหนด

ในกรณีที่บริษัทไม่สามารถดำเนินการตามคำขอได้ บริษัทจะชี้แจงเหตุผลตามที่กฎหมายกำหนด

บริษัทจะไม่เรียกเก็บค่าใช้จ่ายสำหรับการใช้สิทธิโดยไม่เหมาะสมหรือเกินสมควร ทั้งนี้ ในกรณีที่กฎหมายอนุญาต บริษัทอาจดำเนินการตามหลักเกณฑ์เกี่ยวกับค่าใช้จ่ายที่กฎหมายกำหนด

20. การจัดการความยินยอมด้านการตลาด

ในกรณีที่การประมวลผลข้อมูลเพื่อการตลาดจำเป็นต้องได้รับความยินยอม บริษัทจะขอความยินยอมโดยแยกจากความยินยอมอื่นอย่างเหมาะสม

บริษัทจะไม่ถือว่าการยอมรับเงื่อนไขการให้บริการหรือการซื้อสินค้าเป็นการให้ความยินยอมทางการตลาดโดยอัตโนมัติในกรณีที่กฎหมายกำหนดให้ต้องได้รับความยินยอม

ท่านสามารถถอนความยินยอมหรือยกเลิกการรับข้อมูลทางการตลาดได้โดย:

• กดลิงก์ยกเลิกการรับข่าวสารในข้อความที่ได้รับ
• ปรับการตั้งค่าที่เกี่ยวข้อง หากมี
• ติดต่อบริษัทโดยตรงที่ info@peonsu.com

หลังจากถอนความยินยอม บริษัทจะหยุดการประมวลผลเพื่อวัตถุประสงค์ทางการตลาดตามขอบเขตที่กฎหมายกำหนด

อย่างไรก็ตาม บริษัทอาจยังคงติดต่อท่านในเรื่องที่จำเป็นต่อการให้บริการ เช่น การยืนยันคำสั่งซื้อ การชำระเงิน การจัดส่งสินค้า หรือเรื่องที่เกี่ยวข้องกับบัญชีของท่าน

21. การร้องเรียน

หากท่านมีข้อกังวลหรือข้อร้องเรียนเกี่ยวกับการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่าน กรุณาติดต่อบริษัทก่อนเพื่อให้บริษัทมีโอกาสตรวจสอบและแก้ไขปัญหา

ท่านยังมีสิทธิร้องเรียนต่อสำนักงานคณะกรรมการคุ้มครองข้อมูลส่วนบุคคล (PDPC) ตามสิทธิและช่องทางที่กฎหมายกำหนด

22. การเปลี่ยนแปลงนโยบายความเป็นส่วนตัว

บริษัทอาจปรับปรุงหรือแก้ไขนโยบายความเป็นส่วนตัวฉบับนี้เป็นครั้งคราว เพื่อให้สอดคล้องกับ:

• การเปลี่ยนแปลงของบริการ
• การเปลี่ยนแปลงวิธีการประมวลผลข้อมูล
• การเปลี่ยนแปลงผู้ให้บริการ
• การเปลี่ยนแปลงกฎหมายหรือหลักเกณฑ์ที่เกี่ยวข้อง
• การเปลี่ยนแปลงแนวทางการดำเนินธุรกิจของบริษัท

เมื่อมีการแก้ไข บริษัทจะปรับปรุงวันที่ “ปรับปรุงล่าสุด” และดำเนินการแจ้งให้ท่านทราบเพิ่มเติมเมื่อกฎหมายกำหนดหรือเมื่อการเปลี่ยนแปลงมีนัยสำคัญ
